Terms and conditions of sale
Our terms of sale
Last updated:
This English version is provided for convenience. The French version prevails, and the contract is governed by French law.
Article 1. Purpose and seller
These terms and conditions of sale govern any order placed on the Eonelya website by a consumer. The seller is Cosmika : nom commercial de Matthieu Antonin Castellucci, entrepreneur individuel (EI), 47 rue Vivienne, 75002 Paris, France, 107 729 972 R.C.S. Paris. Contact: [email protected], +33 6 13 86 23 32.
Placing an order implies unreserved acceptance of these terms, confirmed by a checkbox before payment.
Article 2. Nature of the product (essential)
Eonelya sells a digital gift experience: the symbolic and decorative dedication of shares of a nebula fragment, recorded in a beneficiary's name in a private registry kept by the seller, together with a personalized certificate (PDF file) and an online gift page.
The customer expressly acknowledges that this product confers no ownership and no legal, scientific, financial or official right over any celestial object; that no authority (in particular the International Astronomical Union) recognises this dedication; that no space organization (NASA, ESA, ESO, NOIRLab) sponsors or endorses Eonelya; and that the product is neither an NFT, nor a security, nor an investment.
Article 3. Prices
The price of one symbolic share is €2.90 or €4.90 depending on the chosen nebula, displayed on each product page. The total is the share price multiplied by the number of shares chosen. Prices are shown in euros. VAT not applicable (French small-business scheme, article 293 B of the CGI). The exact amount charged is shown before payment is confirmed.
Article 4. Order and payment
An order follows four steps: choosing the nebula and number of shares, personalization (beneficiary, dedication, delivery date), review, then payment. Payment is processed by Stripe on a secure page. No banking data passes through or is stored on the seller’s servers. The order is final once payment is confirmed by Stripe; a confirmation email is sent.
Article 5. Delivery
The product is entirely digital: nothing is shipped. After payment, the dedication is recorded in the private registry and the gift page and certificate are made available immediately (immediate delivery) or on the date chosen by the customer (scheduled delivery). When a beneficiary email address is provided, the gift page link is sent to it automatically. If sending fails, the customer can share the link from their confirmation page.
Article 6. Right of withdrawal (important)
Under article L221-18 of the French Consumer Code, the consumer has a fourteen (14) day withdrawal period from the conclusion of the contract, which may be exercised without reason or penalty.
Applicable exceptions. Because the certificate is personalized digital content (beneficiary name, dedication) supplied immediately in the case of immediate delivery, the right of withdrawal does not apply where, at the time of the order, the customer:
- expressly requested immediate performance of the contract, and
- waived their right of withdrawal: by accepting these terms and conditions before payment, the customer requests immediate delivery of their gift and acknowledges thereby losing their right of withdrawal (art. L221-28, 1° and 13° of the Consumer Code).
Scheduled delivery. Where the customer chooses a future delivery date, no request for immediate performance and no waiver are collected: the exception above does not apply. The fourteen-day withdrawal period runs from the conclusion of the contract, that is, from the order, and not from the delivery date; it applies in full, including where delivery has taken place in the meantime. The customer may withdraw throughout that period and obtain a full refund; a later delivery date does not extend it.
To exercise withdrawal where it applies, simply write to [email protected], quoting the order number. The refund is issued within 14 days using the same payment method. A model withdrawal form is reproduced below.
Model withdrawal form
To Cosmika : nom commercial de Matthieu Antonin Castellucci, entrepreneur individuel (EI), 47 rue Vivienne, 75002 Paris, France, [email protected] I hereby give notice that I withdraw from my contract for order no. …………, placed on …/…/…… Consumer's name: ………… Consumer's address: ………… Date: …/…/……
Article 7. Conformity guarantee
The digital content supplied benefits from the statutory guarantee of conformity (art. L224-25-12 et seq. of the French Consumer Code). If the certificate or gift page is unavailable, unreadable or does not match the order, the customer may request that it be brought into conformity free of charge by writing to the contact address; failing that, a price reduction or termination of the contract with a refund may be obtained.
Article 8. Availability period
The seller undertakes to keep the gift page and certificate accessible for a minimum of three (3) years from the order date. As the certificate is downloadable as a PDF, the beneficiary is advised to keep a copy.
Article 9. Personal data
The processing of personal data is described in the privacy policy. The customer warrants that they are entitled to provide the beneficiary’s email address and first name.
Article 10. Complaints and mediation
Any complaint may be sent to [email protected]. Failing an amicable solution, the consumer may refer the matter free of charge to the consumer ombudsman: CM2C, Centre de la médiation de la consommation de conciliateurs de justice, 49 rue de Ponthieu, 75008 Paris: https://www.cm2c.net/declarer-un-litige.php.
Article 11. Governing law
These terms are governed by French law. In the event of a dispute, the French courts have jurisdiction, without prejudice to the protective rules applicable to consumers residing in another EU Member State.
